Avonmouth Consent-Application for Judicial Review

Helius Energy plc has been advised that an application for judicial review of the section 36 consent and deemed planning permission (the "Avonmouth Consent") granted by the Secretary of State for Energy and Climate Change for the Company's Avonmouth biomass project has been filed with the High Court by Coedbach Action Team Limited, which Helius Energy plc understands is a corporate vehicle for the Coedbach Action Team.
The Coedbach Action Team is a group of residents who are presently engaged in resisting proposed power station developments in Swansea and Coedbach in Wales, neither of which developments are related to Helius Energy plc or the Avonmouth biomass project.
Helius Energy plc believes there are no valid grounds for a judicial review of the Secretary of State's earlier decision awarding the Avonmouth Consent and, on the basis of the information provided to date, believes that the Treasury Solicitor will defend this challenge.
